Free Trade Agreements and Investment Protection: A critical perspective from the Global South

Bilateral Investment Treaties have proliferated throughout the world in the last 25 years. But, how do you understand and explain this phenomenon? What factors help us explain the extraordinary legal prerogatives granted to foreign investors? The researcher Luciana Ghiotto (UNSAM / CONICET) explained that these treaties are part of a new international legal framework composed of thousands of bilateral treaties that aim to reduce the uncertainty of the process of capital accumulation by means of incorporating arbitration mechanisms in the treaties. This has a direct impact on the functions of national states, pushing for their reconfiguration.
